Ayatollah Makarem Shirazi: Jurisprudence main source of deriving laws of Islamic society

Grand Ayatollah Makarem Shirazi, pointing out that jurisprudence is the main source of deriving the laws of the Islamic society, clarified,” it is the jurist that obtains the main source of these laws by inferring the ruling of God based on the existing evidences and arguments and provide them to the legislators; therefore, establish the laws needed by the society.”

AhlulBayt News Agency (ABNA): Grand Ayatollah Makarem Shirazi, pointing out that jurisprudence is the main source of deriving the laws of the Islamic society, clarified,” it is the jurist that obtains the main source of these laws by inferring the ruling of God based on the existing evidences and arguments and provide them to the legislators; therefore, establish the laws needed by the society.”

Senior scholar Grand Ayatollah Nasser Makarem Shirazi, in a message to the 4th International Conference on Jurisprudence and Law under the title of "Religious Governance and Regulating Basic Contemporary Issues" stated:

In the name of God

First of all, I would like to thank all the officials and those involved in this conference and I hope that this conference will achieve its desired goals.

Law is one of the basic needs of human societies, and the best laws are the ones that are given to humans from the Almighty God and through the prophets. The divine laws provide the interests of man in his livelihood and salvation in the resurrection, and obeying the divine laws is actually the implementation of the will of God Almighty in human life.

Jurisprudence is the main source of deriving the laws of the Islamic society, and these jurists are the ones who, by inferring God's ruling based on existing evidence, obtain the main basis of these laws and provide them to the legislators to enact the laws needed by the society.

It seems that there is a long way ahead to achieve this important goal, that is, the interaction between the legislator and the jurisprudence, the establishment of laws in accordance with the holy Sharia, and then knowing the basic issues and regulating them based on the votes selected and approved by the two bodies of legislation and jurisprudence. And a large part of walking this path depends on both groups familiarizing with each other.

With the entry of seminarians into the field of knowledge of the law and related matters, and on the other hand, the familiarity of the legislators with the system of jurisprudence and its requirements, and attention to the framework accepted by the jurists, it is possible to obtain useful results and, of course, laws that are comprehensive. Both of the above aspects will be accepted to a large extent by our religious and advanced Muslim society.

I hope this conference can provide solutions for this issue.
